Gender Ruling Advice

European Court of Justice Ruling: Customer Advice

The European Court of Justice has announced that the use of gender based risk pricing in insurance will no longer be permitted from 21 December 2012.  This does not impact your existing RIAS policy in any way.  The ruling applies to all insurers in the UK market.

Currently, insurers apply different premiums, policy terms and benefits to men and women across a range of products based on proven statistical gender differences. For example, young women usually pay much less for their motor insurance than young men based on their respective safety records.

As an over 50s insurance intermediary, we will work with our insurance partners during the interim period up to December 2012 to ensure a smooth transition and minimal disruption to our customers.

Any changes our insurance partners make will be fully communicated to our customers, and any updates will be available on our website.

CIE Update

Identifying uninsured drivers with the new Continuous Insurance Enforcement

From Monday 20 June 2011, it will be an offence for anyone to keep an uninsured vehicle unless it has been declared off the road, through completion of a Statutory Off Road Notice (SORN).

What is Continuous Insurance Enforcement (CIE)?
The CIE is a new enforcement approach launched by the government to help reduce the level of uninsured drivers in the UK. The CIE is a co-ordinated approach by the Department for Transport, the DVLA, the insurance industry and the police to tackle the issue.

Details of the new measures will be distributed to registered car owners with all V11 tax renewal forms.  A television campaign to increase the awareness of CIE has been launched, whilst guidance, and a video explaining the new CIE, is also available at direct.gov.uk.

Road Safety Minister Mike Penning said:

“Uninsured drivers are a danger on our roads, killing 160 and injuring a further 23,000 people each year, and they cost honest motorists £500 million in extra premiums.  That is why we are introducing this tough new law which will leave uninsured drivers with nowhere to hide”.

What is the impact of the CIE?

The new rules intend to crack down on uninsured drivers to reduce the risk they pose by driving uninsured as well as the extra premiums those correctly insured pay. However innocent drivers could also be at risk of penalties or further action through a simple oversight. 

The new offence of “keeping a vehicle without insurance” will be policed from records at the DVLA and Motor Insurers’ Bureau, which will flag when insurance runs out and is not renewed.  Those planning a long trip away would be best advised to check their motor renewal dates now, prior to departure, to ensure they are not at risk or faced with a nasty surprise on return!

What are the penalties under the new CIE?

Under this new system, the DVLA will work with the Motor Insurers’ Bureau to identify uninsured vehicles:

  • Motorists will receive a letter informing them that their vehicle appears to be uninsured and warning that they will be fined unless they take immediate action.
  • If the registered keeper fails to insure the vehicle they will be given £100 fine.
  • If the vehicle remains uninsured (regardless of whether a fine has been paid) further action will be taken.  If the vehicle is on public land it could be clamped, seized or destroyed.  Alternatively court action could be taken, with the offender facing fines of up to £1,000.
  • If the vehicle is seized, it would only be released upon evidence of current insurance for the registered keeper and/or for the person proposing to drive the vehicle away.
  • Vehicles with a valid SORN will not be required to be insured.

What does it mean for you?

You can check now that your vehicle is registered correctly on the MIB database by using the link below.

If you are due to be away from home for any length of time, check the dates for your motor renewal.  Put a note in your diary or alternatively organise for your vehicle to be SORN before you go away. These simple tips will help you avoid being affected by the CIE.

When you are renewing your insurance, always make sure that you provide your details clearly and accurately, as any erroneous errors could leave you at risk under the new scheme.

Always check your policy documents carefully when you receive them and ensure that you notify us immediately of any corrections that need to be made.
